If someone no longer has the capacity to deal with their affairs, but has not prepared a lasting power of attorney, it is necessary to apply to the Court of Protection for a deputy to be appointed. This can be a member of the family, a close friend or professional adviser, who is able to take over the person’s financial affairs. A person can also apply to be a ‘health and welfare’ deputy and the Court can also make treatment decisions on behalf of someone who lacks capacity.
